This is the sum and substance:
Because the petitions give cause to believe there are grave statutory and constitutional issues with the Mandate, the Mandate is hereby STAYED pending further action by this court.
Here’s the whole of it:
The government has until 5PM Monday to respond. We shall see.
Unfortunately with the way the SCOTUS has kicked the two or three cases (ACB, Soto) where they have had the opportunity to stop employer mandates probably already tells us what the ending of this will be.
From a layman's perspective (that is, mine) every bit of sanity that now exhibits itself in our court system - and every appeal to legislated law and the Constitution - is something to celebrate. Such rulings make it more difficult for en banc courts, appellate courts, or the SCOTUS to argue contrary to them without appearing to have overt political considerations or motives. Thanks Mark for the timely notice of this!
