Justice Sotomayor is again bringing non-record anecdotes into the argument -- who are these people not seeking important medical treatment for fear of getting COVID in a medical facility? The opposite it true -- sick people being barred from critical treatment b/c not vaxxed.

That’s not a “point,” and it’s not incumbent upon him to disprove it. The government may act if it has the power to do so, and may not if it doesn’t; it may not do whatever it wants unless someone can explain why it can’t. That would invert our entire system and destroy the law.

I'm pro-vax, but the problem that govt is facing right now isnt from the unvax, but from infections and hospitalizations among the fully vax as relative protection of fully vax has eroded.

even if vaccines live up to lesser promise of preventing severe disease, their more or less abject failure to prevent infection has apparently given rise to operating problems at hospitals due to staff shortages. This would not have been problem if vaccines worked as expected.

Today was a bad day for the Court’s legitimacy, with multiple justices spreading disinformation about children on ventilators and daily cases exceeding total US population.

There were a number of instances in recent years that opened the eyes of ordinary folks to incompetence, bias and corruption in the judiciary (eg Sullivan, Michael Kwan or the 131 federal judges who didn’t declare financial conflicts). But today feels like a watershed moment.

It’s hard to convey the disrespect showed by Justices Sotomayor and Breyer today.
100 million Americans are affected by the Biden COVID mandates.
And these Justices showed up unprepared, inventing COVID numbers to support whatever legal conclusion they’ve already reached.

Overall, the anti-mandate lawyers did well today. They held some punches, particularly when the Left-wing justices put out misinformation on Covid. Personally, I would've preferred the lawyers to push back on some of the glaring errors, but I understand their restraint.

Sounds like the NYT is telling its readers the Biden OSHA vaccine mandate is going down
I know the liberal judges still seem to have no idea that the vaccines don’t end infection or transmission, but they aren’t the majority.
…
I suspect the OSHA mandate goes. What happens to health-care workers may depend on whether Roberts and Brett Kavanaugh know the science well enough to understand how useless the vaccines have become.

the view of some US Supreme Court justices (and Canadian politicians) that vaccine mandates would lead to overnight disappearance of disease was over-egged with Delta, but, in respect to Omicron, has reached cargo cult anti-science.
Breyer, Sotomayor & Kagan are the three STUPIDs. STUPID is an acronym meaning this: Sociopath Tyrant Using Panic Imposes Despotism. STUPIDs use COVID-19 to justify all manner of abuses of power. Proverbs Chapter 29 describes our current situation very well.
