Will this rampant and uncontrolled display of judicial activism finally be enough to dispel Roberts of his foolish and naive idea that there are no Obama judges, no Clinton judges, no Bush judges, only judges. If this naked political maneuvering doesn’t convince Roberts that some judges do indeed sacrifice judicial integrity on the altar of a partisan agenda, then as the old saying goes, he just isn’t paying attention. I sincerely hope that you are right Mark about a SCOTUS smack down heading toward these rogue judges.

I don't know what the record might have been, but the list is pretty short of District Judges who have had the Supreme Court step in and issue a stay on a TRO issued by him/her.

About 99% of the decisions made by District Judges never even get reviewed -- that's why the position is so powerful.

So, to have the CJ step in an stop what a District Judge has ordered to take place is pretty extraordinary.

This case and the issues surrounding it demonstrate why judges who identify as Democrats are not interested in upholding law they are interested in moving their ideology forward. This is nothing more than chaos on behalf of ideology. They should be investigated to see if they are profiting off of the grift.

Right. Didn’t Trump make all fired feds an severance offer of 8 mos salary plus vacation days? - which, iirc, many did accept? So why the order from this judge?

US is still operating on Truman's "America Last" post WWII architecture binding US taxpayers to saving the world from Communism or misc. "threats to freedom." 4 months after FDR's death Truman dropped two nuclear bombs on civilian populations, something that today would be called terrorism. Going into 1944 Dem. convention, the then ailing FDR's choice for VP was Henry Wallace. Everyone knew FDR was going to die soon so his VP out of 1944 convention was guaranteed to become president. Convention delegates wanted Wallace who was not a warmonger. But Deep State wanted a globalist warmonger so kept the convention going until they got rid of Wallace.

I am familiar with how the deep state made sure that Wallace wasn’t nominated and am in no way suggesting that Truman was any better than FDR. But here we have a clear example of the uniparty fighting over methods of enslavement. On the one side you have the globalist who nuked Japan and went on to create the MIC. Then on the other hand you have the collectivists with their social programs ran rough shod over the principles of the constitution and the limits of the federal government. Two forms of tyranny with the end result being the same for the US citizen….a return to serfdom.

Good analysis by Cleveland and you.

I don't always agree with Roberts, but I think sometimes criticism of him becomes ad hominem, insulting him and imputing bad motives when they're not warranted.

It's not necessarily a bad thing that he is concerned with the legitimacy of the court.

His preferred mode is incrementalism, but from a jurisprudential standpoint he is on our side. I agree that the district courts will play a role. They're revealing themselves to be nakedly political and concerned mostly with power--the antithesis of what Roberts wants the judicial branch to represent. The 'conservative' justices who have been dismantling the legal structure of the Admin State in case after case over the last several terms understand this completely.

Do you believe R Vought is architect of legal strategy or is there another -- given their wise war-gamed moves in other areas it is encouraging to hope they have mapped this out beyond the near term wins, ie how far out can you game plan or predict where this leads, and how get it to stick beyond the Trump years?

I believe he would have been in on the legal side, given that he's the driving force behind implementation, and that includes foreseeable legal challenges. Who did the actual legal prep is open to question. AC's suggestion makes sense, but there could be others as well.
