I have thought “Okay, finally this is it, justice is actually going to be served!”, so many times, that I’m overcome with cynicism to the point that my response is, yeh, right. I won’t be holding my breath in anticipation. The Session’s and Barr show s really did a number on me.

Yes, the so-called "crime-fraud exception." The most-commonly-cited statement of the exception comes from the DC Circuit:

“To establish the exception . . . the court must consider whether the client ‘made or received the otherwise privileged communication with the intent to further an unlawful or fraudulent act,’ and establish that the client actually ‘carried out the crime or fraud.’”

The interesting part is that Durham has had the Perkins Coie billing records for both the Hillary campaign and Fusion GPS for over a year now. Billing records themselves are highly-privileged, and you can bet that PC (and the mega-firm representing them) fought like hell to get their clients (to whom the privilege actually belongs) to stand fast on that privilege. I just can't imagine, with all the contempt they've shown toward judicial process over the years, that all the Clintonistas involved here voluntarily waived privilege.

It was TechnoFog's and Dr. Shipwrecked Crew's hypothesis that Durham's team made an adequate evidentiary showing of actual crime-fraud to get a judge (likely, Eastern District of VA--which then applies across federal courts) to blow up the privilege on those billing records. This is what, I think, makes Durham's case very different from the Lucy-Charlie Brown-football scenario we've come to expect from all matters Clinton going back to Whitewater and Travelgate.

It has never seemed plausible that Durham could be a team member in the coverup,cleverly releasing damning details at intervals, so as to dissipate the anger, defer justice into forever . I have maintained in my own mind the suspicion that Durham is for real, is a courageous man and is proceeding methodically, but the criminals in charge are merely extending him rope and can whenever they choose yank it up tight and end his endeavors. The criminals are allowing him to proceed, in this suspicion of mine, as long as it suits them. How does giving us these details and the prospect of a few hides serve their purpose? Why need they bother with letting Durham continue? To my mind, they're trying to recover some lost confidence, that is, a Biden dismissal of Durham would further erode some support that the really feel they need. Support from whom? Obviously not the lines of us but some contingent somewhere with scales still before their eyes. Left leaning but upright members of DOJ or Pentagon or judiciary or whatever. Otherwise Durham and his ling and winding road is a feature somehow of the relationship between / among various power factions within the cabal. I still remain hopeful that the sheer weight of the fraud (Russia gate, Mueller, Flynn, impeachment 1 &2 , COVID scam/ election 2020, Jan 6, gene therapy mandates, Ukraine, with an entire world to deceive and keep deceiving, will collapse it all in on itself, and it's not going to be revelations from Durham or anybody it's going to be left-leaning normals going "stop with the bullshit" and a coming together of left and right against the elitist globalist criminal cabal.
