In the comments section to Did James Baker Really Skate? Mike Sylwester (h/t) and I had an interesting discussion regarding the Mueller/Weissman theory of prosecution for "conspiracy to defraud the government." To the best of my knowledge this theory has never been tested on appeal: defendants in the cases in which this theory has been used have--again to the best of my knowledge--pled guilty to other charges.
