The Democratic Party Is, Has Been and always Will Be, the Party of Slavery. The Vaccine Mandate is their claim that citizens of the United States are their property to be done with as the Party pleases and exempted at their whim to benefit their political favorites.

I am waiting for the 13th Amendment suits to start.

As much as I enjoyed reading the entire order along with Mark's excellent breakdown of it, Judge Duncan's (concurring) final words were my favorite:

"Whether Congress could enact such a sweeping mandate under its

interstate commerce power would pose a hard question ... Whether OSHA can do so does not.

I concur in granting a stay."

It's the elegance not so much of the prose but of the logic. It's basically, "If Congress were to pass such a measure and the President were to sign it into law, maybe it would pass constitutional muster, maybe it wouldn't - we'd have to take a hard look. But some piddly little, dime a dozen bureaucratic agency that virtually no one would even notice if it disappeared tomorrow? Puh leez!"

Read those few words of the Judge a second time and I dare you to say they don't well express your understanding of both the spirit and the letter of our glorious Constitution.

This is hopeful. That it takes so long to apply what is obvious common sense, is not...we should be able as a civilized society to react more quickly to the crazy and screwball and dictatorial pronouncements of various government tyrants.

Even with this major smack down by the 5th Circuit, don't expect these communists running the country to back off. They'll pull every legal and illegal lever they can to get their way. Next up will be manipulating the decision as to which appeals court most sympathetic to their cause will get to hear the consolidated lawsuits. Their lawlessness knows no boundary...

It's a hopeful ruling, but given that Brandon and his Bolsheviks seem to only apply the law to others and as such make proclamations for corporations to ignore the court, what happens if they thumb their nose at this? It's becoming more obvious that they intend to do whatever it takes to destroy the US.

If you saw General Flynn on Tucker last night, I think he's spot on...

Yep. Courts are only useful in a relatively healthy political biosphere, one where the other branches are willing to restrain their restless itch for absolute power and abide a contrary decision. Our current state is poisoned and rotten. No deference (beyond lip service) will be given to this or any other decision unless it suits some larger schemata. We are in power politics now where federal agencies are ALL weaponized against the People and political enemies especially. If WTP continue our recalcitrance the feds will eventually resort to the ultimate political power-- from the end of the gun.

Unfortunately, you're right, Mikey. A court can issue all the stays or "binding" decisions it desires but has no means to enforce its orders. Enforcement power resides exclusively in the Executive branch. And will be abused by the Executive when necessary or desirable. Has anyone else noticed that AG Garland looks and acts like a scared little bunny rabbit?

So much for all the concern that President Trump had aspirations to become a dictator. Instead our real dictator, Zhou, turns out to be a senile fool who doesn't even make his own decisions - those are made by the faculty lounge committee meeting regularly in Obama's garage conversion.

Yes, as an aside Paski admitted yesterday that high fuel prices were actually a goal of the regime-in order to force their "green" initiatives. They are willing to destroy everything to get their way.

Agree. While the Brandon regime may not enforce the court's rulings, the private companies have a legal precedent to ignore any further dictates by this regime. With that, this regime loses its 'mandate' power and shines an even brighter light on its real goal of power and control, not the general health and welfare of the citizens. The legal ruling also opens the regime up for even more lawsuits should it continue its path of tyranny.
