It also reveals that the Biden admin has silently adopted .... wait for it ... the Trump Admin plan to let states take the lead in deciding what measures are needed and appropriate under their respective laws and Constitutions.

Every time they bring up the pivot to states taking the lead, Biden admin spokesweasels should be asked: "when did the President decide to stop criticizing the Trump plan and embrace it as the solution?"

Biden regime is throwing in the towel because of inevitable SCOTUS overturns of Executive Orders and similar executive agency mandates. By saying it's "up to the states," Biden gets to say "SCOTUS won't let me save you, so now each state has to deal with this individually."

And if bad results continue, the states governors and legislatures get blamed. Biden says: "Not my job, man. Blame SCOTUS."

This also sets the stage for a Dem Congressional races, especially Senate -- "we need a Senate Majority -- preferably >60 votes, to get my judicial picks through the Evil GOP Senate obstruction."

I'll bet they were planning this all along.

I'll stick with my original view. Zhou is throwing in the towel BEFORE the SCOTUS even hears the argument. That puts him in a poor position to blame SCOTUS, especially when he flatly stated--NO federal solution. I think the regime saw things going south so quickly that they decided not to wait for the SCOTUS to put them out of their misery. I think they're trying to "move on," but it won't work. People are too deeply unhappy about the last two years to let this go.

Yes; there's an element of "get out of Dodge City" before the SHTF. No question that's a factor. But they'll will, as is their wont, still blame the SCOTUS, even though the temporal order is backwards. The Modern Left does not feel constrained by pesky details like "causality."

And people "educated" in Public Schools by Woke teachers, and similar incompetents, will lap it up.

I'm generally with you EZ on the speculation that most if not all of the moves the left makes are calculated, but I think it is undeniable that there are people pushing back and that push back is having an effect. I am of the mind that Omicron is no more naturally occurring than the original sars-cov-2. Mainly because the irony of them being unable to draw attention to the engineered aspects of the variant is just too delicious. Omicron is the bolt of lightning out of the blue that God or somebody else with a sense of humor sent to frustrate the criminals. Job well done.

I'll stipulate that the true believers in the Biden Admin (and MSM) probably didn't see this coming, but anyone with a brain could see the SCOTUS is almost certain to shut down the constitutional overreach of mandate-by executive order/OSHA rule making ploy, even if one thought they were a good idea. So, in that sense, I think the pivot we are seeing was inevitable, (unless they WANT to get humiliated in the SCOTUS.)

Also, recall the Biden admin asked several constitutional lawyers if they could do this, but could only find one (Larry Sommers?) who thought is was constitutional. That means they knew deep down this wasn't going to fly when it arrived to the SCOTUS.

One further thought; if they sensed they'd lose, it would not surprise me if they withdraw their case to avoid an explicit SCOTUS ruling, which would prevent them from doing similar things in the future. I suspect they want to keep these options open for future circumstances where they want to rule by edict, even if it will eventually be overturned, but it would take months to get all the way to the SCOTUS, and they can back down before the case is heard, rendering it moot again. If they go to SCOTUS and lose, that's it; they can't do this again in different circumstances because there's a SCOTUS ruling that is binding on lower courts. Biden Admin likely wants to preserve its "plausible deniability" as to the unconstitutionality of ruling by edict.

Right. No one has ever hired me to give advice on constitutional law, but my view is similar. They probably saw the SCOTUS slapdown coming.. What may have triggered this is ...

I think they were hoping they could get enough time to force the mandates on the country and present the SCOTUS with a fait accompli. Instead, there was 1) widespread resistance to the mandates with widespread disruption, and 2) the evolution of the disease exposed the false premises of Zero Covid through vaccination. The data that the SCOTUS receives from amicus briefs, as I've said before, should prove quite overwhelming, and especially when combined with the serious constitutional issues--issues that a majority of the justices have been spoiling to address for years.

Yes. That's a good summary.

Notice how Biden's handling of the pandemic matches up with the Biden admin handling of the Afghan withdrawal? No real plan, just ad hoc "making-it-up-as-they-go," so they appear to be executing a plan, even a poorly thought out one.

Both are the result of not actually having a coherent, well-thought-out plan that might actually work, because they don't have a plan at all.

Welcome to the "Ad Hoc" administration: "whatever has the best optics du jour is our plan du jour."

Will the regime withdraw support for the mandate cases heading to SCOTUS? There are some justices that would enjoy taking a big bite out of the administrative state, where OSHA and the CDC reside, which this case could provide for.

Without the Feds backing the blue fiefdom tyrants, their authority will soon begin to slip with the peasants they rule; and they too will run away from what they've created as fast as they can. And what about those Vax mandates? And a vax just to fly on a commercial airline? It would be the end of their power trip.

I can’t agree. I think the Fed’s will now shower tremendous resources towards the blue states to keep the charade going, while they non-stop throw every dumpster fire that they can at the red states. They won’t back down, this is just a tactical realignment- a shiny object they will employ to keep everyone up in arms and super busy while they steal the midterms. After that, it’s back to the caring and benevolent big Fed boot on out throats.

What if this is just the next next level of the game. Pressure the states to force the mandates by uber-highly rewarding the blue states and uber-seriously punishing the red ones? They can use the same playbook of fake precedent, bogus executive orders and unabashed fear mongering to craft the policies to do so. Whatever smoke and mirrors, carrots and sticks that are used will take years to litigate. Evil empire/social media will prop up and in the meantime, more desperate people will be forced into the corner and take the knee. Dems and their flying monkeys didn't audaciously steal all of that executive and legislative power over the past two decades not to use it when it counts the most for them, and this method of forcing things through hell or high water is clearly their MO at this point. Plus it takes the spotlight off of Biden until after the midterms and will shine it directly on red state governors who will now be 'defying common sense and forcing their citizens to suffer.' May be a bit premature to get gleeful.

Votes? They didn’t need votes in 2020 to lock everything and everyone down with all the destruction that followed that. At this point, all they need is for SCOTUS to punt everything back to the states, another federalized “emergency”(doesn’t have to be disease) and some omnipotent upper tier bureaucratic frontmen with a revamped all out PR fear campaign, backed up 24/7 by the flying monkey MSM, and at that point we’re all trying to survive some new mandates (for our own good) that wreak havoc for a long time while legal challenges are ping-ponged and pac-manned through various court systems for years. In the meantime, one “vaccine hesitant” individual after another hits the wall and goes down to the night king.

I definitely agree that it’s not time to celebrate yet given the fact that these guys are Lucy with the football. They’ve played the psychological game of easing up and then turning around and trying to crush people and I’m not sure they’re completely done yet. One can hope, but just like they played the game with the rent moratorium and Scotus, I would expect they need to do something meaningful to show they really have walked away. Until then I would not give an inch or even blink given the hell they’ve put this country through. And asked for criminals like Fauci and Gates, I’m not going to be happy unless those evil people are at least in prison if not have their neck stretched for the hundreds of thousands of Americans that are dead because of them. In other words, no trust, but verify. (edit - didn't notice that Siri thought I meant scottos instead of scotus - whatever that is)

Yep, Mike. Times a 100. I have a hard time believing politicians at the federal level will do anything other than stopping at nothing to make 2022 voting conditions mimic 2020 as much as possible. (What else do they have?) Maybe this could still happen in the blue states if the feds devolved covid decision making down to the states, but I just don't see it happening till it happens (and maybe not even then). Seems like he just let out the latest in a never ending line of Biden bloopers, in the heat of the moment, and that's about it. I still agree with Mark's basic point that this happened only because the political facts on the ground are so negative for the covid cultists, but the trench warfare continues, unabated.

The voting has me as it should all Americans concerned. I'm wondering if that's their plan B and what else they are thinking since I don't expect them to all of a sudden quite covid, close the southern border, and so many other problems. If they do, call me shocked.

As to Covid, I drove by our largest city park back from the store this afternoon and the line for covid testing was out to the road and up a block or more. Not everyone is ready to move on I guess. Also, one of my son's friends got Covid this past week as did his mom and sister. He's not vaxed, but the other 2 are. They did test positive and all three had mild symptoms for just 3 days. Let's hope that plays out globally.

Wow. very surprising. The Biden admin people must see themselves as now being in desperate shape and are apparently going into preservation (blame) mode to try to extricate themselves from the mess they have made. It seems like they have thrown the baby out with the bathwater in the sense that they did not need to write off their COVID leverage entirely just in the face of anticipated adverse court rulings. Good question re: what happens to St. Fauci and the church of the federal health agencies now.

I have to wonder what this means for the broader WEF / NWO agenda and plans. I mean, their whole leverage has been and is COVID. If that goes away (at least in the U.S.), does that mean something else is on the horizon that they will try to use for leverage here? Or have they given up on the U.S.? Or has Biden pulled the rug out from under them?

Read an interesting theory today about CC and although it's quite in depth, I tend to agree somewhat with his concept that most of the warming is attributable to the earth's core emanating more heat in a cyclical manner. What I was really surprised in was the movement of the magnetic north pole since around the late 40's and an even higher rate in just the past 20 years.

Brett, in particular, has a reputation of being a confirmed skeptic in re the current privileged legal status of the administrative state (cf. Chevron). I believe Amy is also a skeptic as well as the cautious Roberts. Gorsuch made his rep in that regard and Thomas and Alito are fully on board. It would be a legal earthquake if the mandates got upheld. Earthquakes happen, but you're right that recent developments should make an earthquake less likely.
