How badly do these judges have to think the DOJ is doing that they’re actually hedging their bets?

Well, really. This is not the kinda stuff that makes a prosecutor feel confident going forward. SWC tweets:

"Does it seem odd to anyone else that the DOJ seems to now be favoring strictly misdemeanor filings in the more recent J6 cases, and not seeking detention in cases even where there is violent conduct captured on video -- either property destruction or targeted at police?"

Here is what Howell said in August:

“Where we have Congress acting, appropriating all this money due directly to the events of January 6th, I have found the damage amount of less than $1.5 million—when all of us American taxpayers are about to foot the bill for close to half a billion dollars—a little bit surprising,” she said."
