Briefly Noted: Turley On The 'Legally Pathetic' Trump Case; America's Declining World Standing

As I said yesterday, I’m not really interested in the political prosecution of President Trump—not from a legal standpoint which, as Professor Turley says, is simply pathetic. For those who are looking for a simple explanation why this is a strictly political event, FR has an extended quote from a video of Turley discussing it. No real legal expertise required to grok what’s going on:

George Washington University law professor Jonathan Turley warned Manhattan District Attorney Alvin Bragg that New York judges, especially at the Appellate level, will not like his case against Trump.

He said: “This indictment, if it is reportedly following the theory that we’ve been talking about, is political. It’s a raw political prosecution. The indictment may come out with a crime that none of us have heard of.

“But for many months, this bootstrapping theory has been put out there, this idea that you could take a misdemeanor under New York law that has expired, that has a two year statute of limitations, and revive it by connecting it to a federal crime, in this case, the federal election violation

“Now, there’s a host of problems with that.

“First of all, it’s a federal crime the Department of Justice chose not to prosecute.

“Bragg’s own predecessor declined to prosecute it, but he is attempting to bootstrap that federal crime into a state case.

“And if that is the basis for the indictment, I think it’s rather outrageous.

“I think it’s legally pathetic.

“If he’s using the bootstrap theory, which is the only one that’s been discussed publicly, that is unprecedented.

“And I expect that New York judges will have the same reaction of many of us, including people on the left, that this doesn’t read right.

“Under Bragg’s theory, he could take any unproven federal crime and revive a long dead misdemeanor and turn it into a felony.

“That’s going to really, you know, raise concerns for a number of judges.

“But once it gets to the appellate level, he’s going to have a particularly difficult time, in my view,” he said.

This marks the ongoing implosion of the rule of law in America. That’s all. It’s the goal of the Left, and we’ve seen this with the Soros DAs, with the federal governments open border policy, with the entire Covid Regime and the disgraceful abdication of our courts, and in too many other cases to name. It marks the implosion of our constitutional order, which the the collapse of legitimate elections has made clear is coming.

So now let’s shift to national security and foreign policy, because it all flows—theoretically—from our constitutional order. The good news, I guess, is that the Senate has voted to to end the authorization for use of military force that’s been in effect for two decades. Does this mark a return of sorts to constitutional government, is there hope? Time will tell.

What I think comes through in this discussion is that America’s standing in the world is being exposed as resting on raw power—military and monetary—and that foundation is rapidly eroding. Crooke, a specialist in Islamic issues begins with a discussion of the extraordinarily rapid transformation of the politics of the Middle East, which he attributes to the exclusion of America from the negotiations. He compares the resulting oligarchy with American politics, and the destruction of democratic and republican government in the West.
