Is something going on with the SCOTUS? Most readers will be aware that early in the week the SCOTUS heard oral arguments regarding Trump’s claim of immunity from prosecution. Most observers—right and left—agreed that the SCOTUS appeared favorable to Trump. There are a number of ways the SCOTUS could go. One would be to send the case back down for further deliberations—probably meaning punting past the election. With luck, from the SCOTUS’ point of view, Trump would win and they wouldn’t have to engage in a sweeping decision on a difficult issue. The SCOTUS, or certainly this one, prefers narrowly defined issues. Notably, CJ Roberts, for the second oral argument in recent days, came out swinging at the government very aggressively. Is it possible that the conservative justices are seeing political developments that are causing them considerable anxiety? Do they feel pressured to get more involved than they would prefer? Obviously speculative questions. But …
J6 represents for me a gross disconnect between law and Justice. Not implying that law was transgressed, in this case. It was legal abuse from start to finish and the guilty ‘lawyers’ should do hard time.
The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority; ..."
It was never intended to serve the role that it has in some ways usurped and in other ways has been forced upon it. It is poorly suited to the role of adjudicating warring visions of the common good in a nation that is almost evenly split and has lost touch with its foundational aspirations. Very tricky for them, trying to exercise guidance, like tugboat trying to nudge the ship of state in the proper direction. With internal disagreements in the cabin of the tugboat.
Well, Trump's situation is a "Case, in law and equity, arising under this Constitution", so they have the right and obligation to weigh in if Trump's prosecutors don't follow the law.
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. **In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction,** both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
J6 has disillusioned me so much about the entire Judicial System. Perhaps SCOTUS will rule to pushback some of this lawfare, as a way to help Trump indirectly and reduce the perception of the judicial system being biased.
what's most unfortunate is the length of time taken for all this to play out. People have suffered tremendously due to over zealousness on the part of the gov't and the DC trial judges. I'm sure Liz Cheney is wrestling with this recent news. Adam what's his name too. Examples like this are how we will lose our Republic.
Sorry already gone. Why bother to shut the barn door after all the horses have galloped away? The jailing of people walking through the Capitol (who were let in) is egregious. (Not to mention the certainty that federal undercover assets helped incite a riot.) The unequal treatment of these people when compared to others who did the same or worse at other times is an obvious tell that equality under the law is now a meaningless phrase. SCOTUS hasn’t shown the requisite courage to face this.
In fairness, the SCOTUS doesn't have original jurisdiction over these kinds of cases. It has to wait to get cases on appeal--if appeals are filed. Most defendants plead guilty--for financial reasons or out of fear of heavier sentences--so the SCOTUS doesn't get the cases. But SCOTUS can't control that.
Obviously government by SCOTUS can't work--as an institution it was never designed for governing and doesn't have the wherewithal to stage a coup. They do appear to be attempting to provide some direction. Some big cases on the admin state coming up that could force Congress back into acting like a legislature.
On the subject of pencil neck Schiff, did you see that he landed in San Francisco for a big fundraiser and his luggage was stolen out of the car? He had to wear the clothes he wore on the plane to the fancy dinner. So very sad.
SCOTUS is tilting toward Trump. This could not happen without a push from the Deep State. With Bill Barr endorsing Trump and Soros sponsoring pro-Palestinian demonstrations, Biden is being thrown under the bus. The corrupt Dems have made the US a laughing stock. Stick a fork in 'em.

If SCOTUS doesn't step in to stop this banana republic-style abuse of the law then what's the point of SCOTUS?
"what's the point of SCOTUS?"

But for almost all ordinary purposes the SCOTUS doesn't have original jurisdiction, which is why it takes so long for cases to get there:

I pray SCOTUS actually helps those poor souls.

Would that be pencil neck you’re referring to?
Probably Kinzinger. The guy who is always crying.
On the subject of pencil neck Schiff, did you see that he landed in San Francisco for a big fundraiser and his luggage was stolen out of the car? He had to wear the clothes he wore on the plane to the fancy dinner. So very sad.
Can’t abide either of these imbeciles.
Agreed.

No more "skating by" for all in DC. We the People are coming.....
this is going to be Glorious to watch.
