In a stunning constitutional first, the NC Supreme Ct. has declared the North Carolina General Assembly to be illegitimate—for certain purposes—because its current makeup is based on a racial gerrymander. Therefore, says the court, while the General Assembly can conduct business—presumably only with the court’s permission—it can’t do things that the court doesn’t like. The specific example? The court says that the General Assembly cannot enshrine Voter ID and an income tax cap in the State constitution. The Dems have a 4-3 majority on the court and don’t like those amendments to the State constitution:
North Carolina Supreme Court Enacts a Full-Scale Judicial Coup
The amendments in question were to enshrine the state’s voter ID law and to put in place an income tax cap. Those are now in limbo after the Democrat supreme court decided it has supremacy over the duly-elected officials of North Carolina’s voters. It’s hard to put into words how crazy that is and how dangerous of a precedent it is. This is the same court that ruled earlier in the year that the general assembly can’t draw its own congressional map, representing one of the few GOP failures regarding redistricting in a red state.
Democrats currently hold a 4-3 majority on the court, a dynamic almost certain to change after November’s elections where the GOP is favored to take a 5-2 majority. So the good news here is that this insane judicial coup won’t last long. That it’s gotten to this point is still dangerous, though. What happens if courts all across the country start ruling oppositional legislatures are illegitimate?
Of course, the US Supreme Court might have something to say about that.
These judges are insane. Every ruling is a hand out to some special interest group. It’s a far left court in a moderate center right state.
The cities in NC are heading to 💩 fast. Well, Raleigh-Durham, Charlotte, Greensboro-Winston-Salem are. Everywhere else is still nice and sane and thriving. It’s not sustainable.
I am not sure which is the bigger threat to America: that we have an out of control Administrative state, or that at local, state and Federal levels judges who legislate from the bench.
Both are unelected and essentially unaccountable to the people.
And for The Republic to survive, both threats need to be eradicated.
