Are Liberals Inviting A Storming Of The Scotus?

“This decision is a direct assault on the dignity, rights, & lives of women, not to mention decades of settled law. It will kill and subjugate women even as a vast majority of Americans think abortion should be legal. What an utter disgrace.”

I’ve read a number of views on the leak of the forthcoming abortion opinion—Politico published the draft majority opinion that overturns past cases. The draft was written in February and is probably waiting for dissenting opinions to be finished. One suspects—this one does, anyway—that the scheme was for at least one dissenter to hold out the opinion until the latest possible day in the hope that all liberal hell will break lose around the SCOTUS building in the meantime. Is it an insurrection if a mob storms the SCOTUS building? The rhetoric from the usual suspects is very heated already.

Here’s Professor Jonathan Turley’s view—he sees this as a body blow to the Court’s standing. But since when did liberals care about the integrity of our basic constitutional institutions?

The alleged leak of the opinion in Dobbs v. Jackson Women’s Health Organization is nothing short of breathtaking. It would constitute one of the greatest breaches of security in the history of the Court.

...The article represents the greatest crisis that Chief Justice John Roberts has faced in his tenure on the Court. It is a breach of the most fundamental obligations and traditions of the Court.

...If this is a true copy of the draft opinion it is hard not to view this as a malicious act. What is the motivation of releasing such a decision? The only intent of such a leak is to trigger a response from outside of the Court.

...This draft is from February and the majority can shift on such opinions. However, the act of leaking such a draft opinion ranks as an original sin for judicial ethics.

...The most likely motivation is obviously to pressure the Court and push the legislation in Congress on a federal abortion law before the midterm elections. It will also likely renew the call for court packing.

Our constitutional crisis deepens, and don’t expect the GOP to be of much use—just as much of the party has been complicit in the assault on the Trump administration and the continuing coverup of all that has happened since 2016. This is just one more in a string of attacks.

A person called Amit Jain clerks for Supreme Court Justice Sonia Sotomayor. As a Yale student, Jain blasted Yale for supporting Brett Kavanaugh's nomination. Jain was quoted in a 2017 Politico piece by Josh Gerstein. Today, Gerstein published the draft SCOTUS opinion on Roe.

While it is speculation, if I were a reporter with a contact who became a SCOTUS clerk I would certainly maintain that contact and milk it for everything it could be worth. Not proof, but worth exploring.
